Simply Open Awards - Terms and conditions

1. General

  1. This competition is organised and administered by Open Inclusion Limited, a Limited Company registered in England and Wales under number9394123 (“Open Inclusion”). 
  2. These terms and conditions govern applicants’ participation in the competition known as The Simply Open Awards (the “Simply Open Awards”).
  3. Open Inclusion Limited reserves the right to amend these terms and conditions at any time without notice by publishing updated terms and conditions at www.simplyopen.io/awards (the “Website”).
  4. Completed applications must be submitted on the Simply Open Awards website from Thursday 18 May 2023 @ 00:01 and by Friday 22 September 2023 at 23:59 GMT.
  5. By submitting an application to the Simply Open Awards, all applicants agree to be bound by these terms and conditions in full.
  6. Open Inclusion Limited reserves the right, in their sole discretion, to cancel or suspend the Simply Open Awards should causes beyond their control interfere with the administration of or proper participation therein.
  7. Open Inclusion reserves the right to offer select sponsorships to business partners of their choice.
  8. Open Inclusion and the Simply Open Awards sponsors assume no responsibility for postal, technical, or natural conditions that prevent the reception and/or judging of an application.
  9. The judges’ decisions will be final and binding, and no further correspondence or discussion will be entered into.

2. Monetary prizes for 2023 

A total of £25,000 or the equivalent in the relevant currency will be distributed as follows:

  1. £1,500 to each first-place winner in all five of the Simply Open Awards Categories (£1,500 x 5 winners = £7,500)
  2. £1,000 to each second-place winner in all five of the Simply Open Awards Categories  (£1,000 x 5 winners = £5,000)
  3. £750 to each third-place winner in all five of the Simply Open Awards Categories  (£750 x 5 winners = £3,750)
  4. £500 to each fourth-place winner in all five of the Simply Open Awards Categories   (£500 x 5 winners = £2,500)
  5. £100 to each fifth-place winner in all five of the Simply Open Awards Categories   (£100 x 5 winners = £500)
  6. £2,500 to the non-profit or whose members submit the most accepted solutions for the competition.  (£2,500 x 1 winner = £2,500)
  7. £1,000 to the non-profit or whose members submit the most accepted solutions for the competition. (£1,000 x 1 winner – £1,000
  8. £750 for the top three “wildcard” entrees that have not won any other awards but are deemed to be exceptionally impactful by the judges. (£750 x 3 = £2,250)

3. Eligibility and Award criteria 

  1. The awards are open to disabled applicants over the age of 18 operating in the United Kingdom, Ireland, United States, Canada, Australia and New Zealand only. We use the Equality Act 2010 definition of disability, which includes long-term mental and physical health conditions. 
  2. To be eligible, a person must complete a Simply Open Awards application, agree to the terms in the sign-up form and submit a video which is accepted in accordance with the acceptance guidelines stated on the website and application site.
  3. Applicants are allowed to file more than one application. However a solution cannot be entered into more than one category.

4. Application Submission 

  1. The Simply Open Awards will open for entries on Thursday, 18 May 2023 from 00:01 and close on Friday 22, September 2023 at 23:59 GMT. Open Inclusion is not responsible for and will not acceptany applicationreceived after this time. 
  2. Applicants must complete the formal application form via the Simply Open Awards website www.openinclusion.com/simplyopenawards. If a disability prevents such an application, alternative formats will be considered.
  3. All applications and any supporting material must be in English.
  4. Should an applicant require an alternative format, such as dictation or audio file please contact us on simplyopenawards@openinclusion.com.
  5. Open Inclusion and the Simply Open Awards staff reserve the right (at their sole discretion) to contact any applicant to request amendments and/or additional information following submission of an application to ensure that such application meets the minimum requirements set out and described by “Eligibility and Criteria”.
  6. Open Inclusion will not accept applications which include profanity, pornography, indecent images and/or references and/or which infringe the rights of third parties (including without limitation intellectual property rights). Open Inclusion reserves the right to reject any application they consider (acting reasonably) to be incomplete or to contain inappropriate content, or which is not sufficiently clear.

5. Publicity, promotion and other obligations of prize winners

  1. All prize-winners agree to take part, on Open Inclusion’s reasonable written request,in any publicityorpromotional activity surrounding the Simply Open Awards for that year applied.
  2. There will be no disclosure of a disability to the media without the written consent of the award finalists, though we advise finalists that owing to the Awards’ criteria, it is likely most journalists will make a presumption of disability. 

6. Intellectual Property

  1. Open Inclusion is not responsible for obtaining or verifying any intellectual property rights relating toan application. 
  2. The competition is for non-patented material and will be placed in an open-source repository for future reference online.
  3. By submitting an application, each applicant confirms they are the owner and willing to share intellectual property (and moral rights).
  4. The applicant shall fully indemnify, keep indemnified and hold harmless Open Inclusion and any award sponsor companies against all costs, expenses (including legal expenses), damages, losses or liabilities suffered or incurred by Open Inclusion’s applicant’s infringement of the intellectual property rights of a third party. For the avoidance of doubt, where the relevant application is submitted by more than one person, the liability of each applying person under this clause shall be joint.
  5. Nothing in these terms and conditions or an applicant’s participation in the Simply Open Awards shall operate to assign or license any intellectual property rights to any third party.  

7. GDPR – your personal data 

  1. In keeping with GDPR, Open Inclusion shall keep all applicants’ contact and personal details confidential and password protected and shall not disclose them to third parties outside Open Inclusion without the written consent of the applicant. 
  2. In keeping with GDPR, applicants understand that in submitting an application, applicants expressly authorise Open Inclusion to use the application data collected during the registration process for the purposes of administering the Simply Open Awards. Open Inclusion shallcollect, store, use, handle and process applicants’ personal data in accordance with its privacy policy (available on the Website) andall applicable laws and regulations.
  3. Applicants shall be entitled at any time to access or amend or delete their personal data held by Open Inclusion by the means of an e-mail or letter addressed to Open Inclusion.
  4. All prize-winners understand and agree that information about them will be made publicly available on the website and can be shared by Open Inclusion and Simply Award Sponsors across any and all media channels.   5. Open Inclusion will not pass on the applicants’ personal data to third parties – with the exception of the independent judging panel - without the applicants’ prior written consent.

8. Judging

The process

  1. Judging is organised by Open Inclusion and Open Inclusion reserves the right to agree all judges for the Simply Open Awards. The finalist’s judging panel will be headed by Open Inclusion and include staff from each of the Simply Awards Company Sponsors.
  2. Finalists will be notified by email on or before 30 November, 2023.
  3. Changemaker sponsor and Open Inclusion (if required) judges will select the three wildcard winners.
  4. The winners will be announced at an online event held via Zoom on Friday, 1 December at 1400 GMT.
  5. Open Inclusion shall pay (or shall procure the payment of) all applicable amounts into the bank account(s) nominated by the winners within 30 days of the winner of the relevant prize being announced.
  6. In the event that a prize-winner refuses a prize, Open Inclusion will decide (at its discretion) how the prize money will be distributed (if at all) and the prize-winner refusing the awards will not have any rights in respect of the prize money or its distribution. 

9. Liability and Termination

  1. Nothing in these terms and conditions shall be deemed to limit or exclude the liability of any party for death or personal injury caused by that party’s negligence, fraud, or any other liability which cannot by law be validly limited or excluded. 
  2. Subject to clause 6i, Open Inclusion or any companies sponsoring the Simply Open Awards shall have no liability (howsoever arising) for any indirect or consequential lossor damage.
  3. An applicant may at any time withdraw an application from the Simply Open Awards on written notice to Open Inclusion. When an application has been submitted by more than one person, an application shall not be deemed to be withdrawn unless and until each applying person has notified Open Inclusion in writing.   4. Without prejudice to any other right or remedy which it may have, Open Inclusion or any Simply Open Awards sponsorship companies shall be entitled, at their absolute discretion and on written notice, to terminate the participation of an applicant to the Simply Open Awards for breach of these terms and conditions or for bringing into disrepute Open Inclusion.

For the purposes of clarity: 

  • ‘Simply Open Awards sponsorship companies’ refers to any company donating a monetary gift to support the facilitation of the Simply Open Awards. 
  • ‘Applicants’ refers to anyone who enters the competition to win an award.
  • ‘Application’ refers to the form filed with Open Inclusion to enter the Simply Open Awards’ competition.
